The deal, in plain words.

1. What nosh does

nosh is a workspace where you describe the app or website you want and an AI builder makes it with you. Each customer gets their own private workspace. You can preview your work as you go, and pay for more building credit, ready-made apps and help from our expert developers.

2. Your account

• You must be 18 or older and give us true details, including a WhatsApp number we can reach you on.
• One free trial per person and per WhatsApp number.
• Keep your password private. You're responsible for what happens in your account.
• If you sign up for a business, you confirm you may agree to these terms for it.

3. Free trial

The free trial includes 5 changes (a change is one thing you ask nosh to do) and needs no card. To keep the platform fast for everyone, trial workspaces that haven't been paid for are deleted 14 days after sign-up. We email you 3 days before that happens.

Some ready-made apps can be tried for free first: your own copy, with 3 changes within 3 hours. While you're trying it, the app's source code stays with us; it becomes yours when you buy, and everything you made in the trial is kept. A trial app that isn't bought is deleted 48 hours after the trial ends. Each person (and WhatsApp number) gets one free trial.

4. Packages and build credit

• Packages are monthly: Build R250, Launch R350 and Expert R500, paid through PayFast. Each gives you a month of build credit; the number of changes shown is an estimate on our Standard AI model. Smarter models use credit faster.
• Top-ups (R100) add credit to the current month.
• You can cancel a package any time from your workspace home. It won't renew, and you can keep using the credit you have left. We don't refund part-months.
• If a payment fails, building pauses until it's paid. We may change prices with 30 days' notice by email.

5. Ready-made apps (templates)

• A ready-made app costs a once-off fee (currently R3,000, which includes your first month), then a monthly fee shown on its page (currently R500 or R1,200).
• The monthly fee pays for your expert developer, who adds features and maintains your app, plus build credit.
• Minimum term: 12 months from purchase. If you stop before then, the remaining monthly fees for the 12 months are still due. After 12 months you can cancel any time with 30 days' notice by WhatsApp or email.
• One purchase is one app for one business. We set the template up in your workspace once. You may use it for that app and business, but you may not copy it into other apps, resell it, share it, or publish its source code. The once-off fee isn't refundable once the app has been set up in your workspace.

6. Expert developers

• With the Expert package or a ready-made app, a nosh expert developer helps you: you can ask in any chat (type /expert), and they reply in the same chat.
• To do that, our experts can open your workspace and work in your chats and files. They can't see or change your billing. You'll see when an expert is in your workspace and when they last worked on your app.
• On any plan, connecting a real backend (accounts, databases, payments, notifications) is done by our team. When you or the builder ask our team for help, our experts may open your workspace for the next 7 days to do it, and we may contact you on WhatsApp.
• Experts help in South African business hours on a reasonable basis. Big new projects may need a separate quote.

7. Your work belongs to you

You own your ideas, your business information and the app built for you (ready-made apps are licensed to you as described above). We only use your work to provide nosh to you. Ask us any time and we'll export your project for you.

8. Fair use

Don't use nosh for anything illegal, harmful or deceptive; to build malware or spam; to break into anyone's workspace or overload the platform; or to resell nosh's AI credit. We may pause or close accounts that do.

9. AI and your app

AI can make mistakes. Check your app before you rely on it or put it in front of your customers. You're responsible for how your app treats your own customers (for example their privacy and payments). Publishing to the App Store or Google Play isn't included unless we agree it with you.

10. Service, liability and the law

• We work hard to keep nosh running and back up every workspace nightly (kept for 7 days), but we can't promise it will never be down. Keep copies of anything critical to your business.
• As far as the law allows, our total liability to you is limited to what you paid us in the 3 months before the problem, and we aren't liable for indirect losses such as lost profits. Nothing here takes away your rights under the Consumer Protection Act or other South African law where they apply.
• If you close your account, we delete your workspace 30 days later (ask for an export before then). South African law applies to these terms.
• We may update these terms; we'll tell you by email before important changes take effect.

11. Privacy: how we look after your information

We follow the Protection of Personal Information Act (POPIA). NOSH DEV (Pty) Ltd is the responsible party; our Information Officer can be reached using the contact details below.

What we collect

• Your name, email address and WhatsApp number, and your Google account details if you sign in with Google.
• What you describe and build: your chats, files and project.
• Billing status (what you bought and when). PayFast handles your card; we never see or store card details.
• Technical information needed to run and protect the service, such as sign-in cookies, IP address and how much build credit you use.

Why we use it

To run your workspace, build your app, bill you, keep the platform safe, let our experts help you (including contacting you on WhatsApp), and send you service emails such as receipts, reminders and trial notices. We won't send you marketing without your consent, and you can opt out any time.

Who helps us (and may process your information)

• Google Firebase: accounts and sign-in.
• PayFast: payments.
• OpenRouter and the AI model providers it connects to: your prompts and code are sent to them to generate the AI's replies.
• Hostinger (servers in the United Kingdom) and Cloudflare: hosting, network and security.
• Resend: sending our emails. Telegram: alerting our own team about your requests.
• Meta (Facebook and Instagram): the Meta Pixel on our website tells Meta which pages were visited and when someone signs up, starts a trial or goes to pay, so we can measure and improve our ads.

Some of these process information outside South Africa. We only use providers with appropriate protection for personal information, as POPIA requires.

How long we keep it

While your account is active; unpaid trial workspaces are deleted after 14 days, and unbought trial apps 48 hours after the trial ends (we keep your account details, so you can come back and buy); backups are kept for 7 days; billing records are kept for 5 years because tax law requires it.

Your rights

You can ask to see, correct or delete your information, or object to how we use it. If you're unhappy with our answer, you can complain to the Information Regulator (inforegulator.org.za). We use cookies to keep you signed in, and on our website the Meta Pixel uses Meta's cookies to measure our ads. You can block those in your browser, or limit them in your Facebook ad settings. nosh isn't meant for anyone under 18.
